{"id":8124,"date":"2020-03-09T16:13:37","date_gmt":"2020-03-09T16:13:37","guid":{"rendered":"http:\/\/alerion-avocat.eliott-markus.digital\/?p=8124"},"modified":"2020-04-23T13:44:56","modified_gmt":"2020-04-23T13:44:56","slug":"employment-law-and-digital-platforms","status":"publish","type":"post","link":"https:\/\/www.alerionavocats.com\/en\/employment-law-and-digital-platforms\/","title":{"rendered":"Employment law and digital platforms"},"content":{"rendered":"<p><strong>Even if no specific regulations exist for the digital platforms, the issues raised by the new ways of working in the <em>\u201cgig economy\u201d<\/em> can explain a couple of recent decisions delivered by the French Supreme Court.<\/strong><\/p>\n<p><strong>Indeed, the <em>Cour of cassation\u2019<\/em>s decision of March 4th 2020 confirmed that when the driver connect to the UBER digital platform, a relationship of subordination between him and the Company was established.<\/strong><\/p>\n<p><strong>Consequently, the lack of independence and the existence of a relationship of subordination could indicate the fictive nature of the independent worker status.<\/strong><\/p>\n<p><strong>The criteria taken into account by the judge were as expected: <\/strong><\/p>\n<p>&#8211; The driver worked for <strong>an organized transport service<\/strong> under terms defined unilaterally by UBER as a result, the driver was unable to: <\/p>\n<p>\u00b7\tOrganize his own professional activity,<\/p>\n<p>\u00b7\tSet his own fares, which were set by UBER\u2019s algorithm,<\/p>\n<p>\u00b7\tChoose his own route without receiving a price correction form UBER,<\/p>\n<p>\u00b7\tChoose freely a ride proposed by UBER, the final destination not necessarily being known by him in advance,<\/p>\n<p>\u00b7\tBuild up his own customers,<\/p>\n<p>\u00b7\tChoose his own suppliers.<\/p>\n<p><strong>&#8211;\tThe exercise of, indirect or disguised, disciplinary power<\/strong> through:<\/p>\n<p>\t(i) UBER is temporarily disconnecting drivers after three ride refusals; <\/p>\n<p>\t(ii) the application of fare adjustments if the driver chooses an <em>\u201cinefficient route\u201d<\/em> different to UBER\u2019s recommended route; <\/p>\n<p>\t(iii) the deletion of the driver&#8217;s account in the event of non-compliance with the cancellation rate set unilaterally by UBER or <em>&#8220;problematic behaviour&#8221;<\/em> reported by users.<\/p>\n<p>From UBER\u2019s side, the driver <em>\u201cremains entirely free to connect to the application or not, to choose the location and the time he\/she intends to connect, without informing the platform in advance, and to put an end to the connection at any moment\u201d<\/em>; this argument has been rejected by the judge.<\/p>\n<p><strong>Impacts of the decision<\/strong><\/p>\n<p>In spite of this decision, the digital platform business model, from the sharing economy, should not be really challenged for the moment, <strong>although further thinking is probably required<\/strong> about its practical implementation. <\/p>\n<p>Indeed, the call into question of the business model will mainly depend on the number of disputes before the courts, which are few to date.<\/p>\n<p>But UBER should not avoid the financial consequences of this decision; reclassification of the employment contract could effectively <strong>lead to the payment of social contributions.<\/strong><\/p>\n<p><strong><em><a href=\"https:\/\/www.alerionavocats.com\/en\/avocat\/jacques-perotto\/\">Jacques Perotto<\/a><\/strong>, partner, and\u00a0<strong><a href=\"https:\/\/www.alerionavocats.com\/en\/avocat\/quentin-keraval\/\">Quentin K\u00e9raval<\/a><\/strong>, associate, in Alerion\u2019s Employment department<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Even if no specific regulations exist for the digital platforms, the issues raised by the new ways of working in the \u201cgig economy\u201d can explain a couple of recent decisions delivered by the French Supreme Court.
